NO USE BY MINORS
To access or use the Website, you must be 18 years of age or older and have the requisite power and authority to enter into these Terms. Children under the age of 18 are prohibited from using the Website directly.

Because we plan family travel, a parent, guardian, or authorized adult may provide information about minor travelers as needed for legitimate travel planning, booking, documentation, and supplier coordination purposes. Any such information must be provided by an adult with authority to do so.

LAWFUL PURPOSES
You may use the Website for lawful purposes only. You agree to be financially responsible for all purchases, deposits, planning fees, hotel bookings, travel arrangements, and other transactions made by you or by someone acting on your behalf through the Website or through any linked form, client portal, payment link, booking portal, or third-party provider.

You agree to use the Website and to purchase or request services through the Website for legitimate, non-commercial purposes only. TRAVEL PLANNING AND ADVISORY SERVICES
Mackey Luxury Travel provides travel advisory, itinerary planning, hotel booking, supplier coordination, and related concierge-style travel planning services. The Website may describe our service offerings, travel planning packages, hotel-only booking services, VIP amenities, sample itineraries, travel inspiration, destination recommendations, supplier relationships, and general travel guidance.

Any information on the Website is provided for general informational and promotional purposes only and does not constitute a binding quote, confirmed reservation, guaranteed rate, guaranteed amenity, guaranteed upgrade, or final itinerary. Travel arrangements are not confirmed until all required client information, payments, deposits, agreements, and supplier confirmations have been completed and accepted by the applicable parties.

For clients who engage us for planning services, a separate planning agreement, proposal, invoice, authorization form, supplier confirmation, itinerary, or other written communication may set forth additional terms. In the event of a conflict between these Website Terms and a signed planning agreement or supplier confirmation, the more specific written agreement or supplier confirmation will generally govern the applicable travel service or booking.

SUPPLIER TERMS, AVAILABILITY, PRICING, AND TRAVEL COMPONENTS
Many travel components are provided by independent third-party suppliers, including but not limited to hotels, resorts, villas, destination management companies, tour operators, transfer companies, cruise lines, airlines, rail providers, insurance providers, restaurants, guides, activity providers, and other travel vendors (“Suppliers”).

Supplier availability, rates, taxes, fees, deposits, cancellation terms, payment deadlines, inclusions, resort credits, breakfast benefits, upgrades, early check-in, late checkout, room assignments, bedding configurations, connecting rooms, suite availability, guides, activities, transportation schedules, restaurant reservations, and other travel details are subject to change until confirmed by the applicable Supplier. Some benefits and amenities may be subject to availability and cannot be guaranteed.

You acknowledge that each Supplier may impose its own terms, conditions, restrictions, liability waivers, documentation requirements, health and safety requirements, cancellation policies, change fees, payment deadlines, credit card authorization requirements, and other rules. You are responsible for reviewing and complying with all Supplier terms applicable to your trip.

We are not responsible for acts, omissions, delays, changes, cancellations, overbooking, schedule changes, strikes, weather events, natural disasters, health advisories, governmental restrictions, force majeure events, service failures, errors, accidents, injuries, losses, or other issues caused by Suppliers or other third parties. Our role is to advise, coordinate, and assist, but we do not own, operate, or control the third-party services that may be included in your travel arrangements.

QUOTES, PAYMENTS, DEPOSITS, AND FEES
Quotes and proposals are based on information available at the time provided and may be subject to change until confirmed. Rates may fluctuate due to availability, exchange rates, taxes, fees, Supplier updates, seasonality, promotions, or other factors outside of our control.

Planning fees, destination discovery fees, elevated escape fees, hotel-only booking terms, cancellation fees, change fees, Supplier deposits, final payment deadlines, and other costs may be communicated separately by invoice, proposal, email, client portal, payment link, or agreement. You agree to pay all amounts that you authorize or that are required to secure requested travel services.

Planning fees compensate us for the time, expertise, research, curation, coordination, and advisory services involved in your trip planning. All travel planning and advisory fees are non-refundable once paid, including if the Client elects to cancel, postpone, change destinations, or otherwise discontinue the planning process, except where expressly agreed otherwise in writing.

Payments for travel components may be processed directly by Suppliers or through third-party payment processors. We do not guarantee the security, performance, or practices of third-party payment processors beyond commercially reasonable efforts to select reputable providers. You are responsible for ensuring that payment information is accurate, authorized, and submitted before applicable deadlines.

CANCELLATIONS & CHANGES

Requests to cancel or materially modify confirmed travel arrangements must be submitted to Mackey Luxury Travel in writing. Supplier cancellation and change policies will apply to each reservation and may result in partial or complete forfeiture of amounts paid. Mackey Luxury Travel does not control Supplier cancellation policies and cannot guarantee refunds, credits, waivers, or exceptions. Any planning, change, cancellation, or administrative fees charged by Mackey Luxury Travel will be communicated separately and are in addition to Supplier-imposed penalties.

CLIENT RESPONSIBILITIES
You are responsible for providing accurate, complete, and timely information needed to plan and book travel, including traveler names as they appear on government-issued identification, dates of birth when required, passport details when required, contact information, dietary restrictions, accessibility needs, health or mobility considerations, bedding preferences, budget parameters, trip preferences, payment information, and any other details reasonably requested for planning or booking purposes.

You are solely responsible for ensuring that all travelers have valid passports, visas, entry authorizations, REAL ID-compliant identification when applicable, travel insurance decisions, vaccinations or health documentation when required, and any other documentation necessary for travel. We may provide general reminders or resources, but we do not provide legal, immigration, medical, tax, or insurance advice.

You are responsible for reviewing all proposals, invoices, confirmations, names, dates, routes, room types, inclusions, cancellation terms, payment deadlines, and itinerary details promptly and notifying us of any errors or requested changes. Failure to review travel documents may result in missed deadlines, change fees, cancellation penalties, or other consequences for which we are not responsible.

TRAVEL INSURANCE
Travel involves risks, including unexpected cancellation, interruption, delay, medical events, lost baggage, supplier default, weather disruptions, and other unforeseen circumstances. We strongly recommend that clients consider comprehensive travel insurance or other appropriate protection for their trip.

Insurance products, coverage decisions, exclusions, deadlines, and claims are governed by the applicable insurance provider. We may provide general information or referral resources, but we do not guarantee coverage, claim outcomes, or reimbursement. You are responsible for reviewing any policy carefully and determining whether it meets your needs.

USE OF FREE DOWNLOADABLE CONTENT
We may make resources on this Website accessible to users in exchange for providing an email address or other contact information (“Gated Content”). Examples may include travel guides, packing lists, destination resources, hotel guides, planning checklists, or other downloadable or emailed materials.

We grant you a limited, personal, non-exclusive, non-transferable license to use the Gated Content for your own personal or internal business use. You agree to hold us harmless from and against all claims, liabilities, and expenses arising out of any actual or alleged copyright, trademark, privacy, publicity, or other rights violation arising from your Submissions.

OUR INTELLECTUAL PROPERTY

GOVERNING LAW; JURISDICTION
These Terms, together with the Privacy Policy and Disclaimer, shall be construed in accordance with and governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. The courts of North Carolina shall have jurisdiction to hear and determine any dispute arising in relation to these Terms.

You agree that any proceeding relating to use of this Website must be filed exclusively in the appropriate state or federal courts located in Mecklenburg County, North Carolina, and you submit to the jurisdiction of those courts and waive any objection based on inconvenient forum or other reasons.

ALTERNATIVE DISPUTE RESOLUTION
The parties agree to attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms by mediation.
